Kare Autism for Life (KAFL)

1. Scope, Purpose, and Acceptance

This Partner & Professional Legal Policy (“Policy”) governs the participation, listing, engagement, and use of the Kare Autism for Life platform (https://www.kareautismfor.life/), including its website, mobile applications, and associated digital services (collectively, the “Platform”) by any individual or entity acting as a professional, organization, institution, employer, or service provider (“Partner”).

This Policy supplements and forms an integral part of KAFL’s:

  • Terms and Conditions
  • Privacy Policy
  • Any role-specific guidelines displayed on the Platform

Digital Acceptance (Legally Binding)

By:

  • registering as a Partner,
  • listing services,
  • uploading content,
  • accepting onboarding prompts,
  • clicking “I Agree”, “Accept”, or similar,
  • or continuing to access the Platform in a Partner capacity,

you irrevocably confirm that you have read, understood, and agreed to be legally bound by this Policy and KAFL’s Terms and Conditions.

If you do not agree, you must not register, list, or participate on the Platform.

2. Platform Role and Consumer Law Positioning (Critical Clause)

KAFL operates solely as a neutral technology platform and information facilitator.

KAFL:

  • does not provide medical, therapeutic, counselling, employment, caregiving, NGO, or professional services;
  • does not control, supervise, manage, verify, certify, or endorse Partners;
  • does not act as an employer, healthcare provider, recruiter, placement agency, fundraiser, or service intermediary.

Partners acknowledge that:

  • KAFL is not a “service provider” in respect of Partner services under the Consumer Protection Act, 2019;
  • Partner services are rendered independently and outside KAFL’s control;
  • Users engage with Partners at their own discretion and risk.

3. Independent Contractor Status

All Partners act solely as independent entities.

Nothing in this Policy creates:

  • employment,
  • agency,
  • partnership,
  • joint venture,
  • fiduciary, or
  • representative relationships.

Partners have no authority to bind, represent, or make commitments on behalf of KAFL.

4. Partner Obligations and Representations

Each Partner represents and warrants that they:

  • hold all required licenses, registrations, approvals, and qualifications;
  • comply with applicable laws, professional standards, and ethical obligations;
  • provide accurate, lawful, and non-misleading information;
  • do not misrepresent services, credentials, outcomes, or affiliations.

KAFL does not verify Partner credentials and relies entirely on Partner representations.

5. User Interactions and Assumption of Risk

All interactions between Partners and users occur directly and independently.

KAFL:

  • is not a party to Partner-user relationships;
  • does not monitor communications or outcomes;
  • bears no responsibility for disputes, advice, services, payments, donations, employment decisions, or results.

Partners assume full responsibility for all consequences of their interactions.

6. Role-Specific Acknowledgements

a) Medical Professionals & Therapists

All medical, diagnostic, therapeutic, and clinical decisions are made solely by the Partner. No doctor–patient or clinician–patient relationship exists with KAFL. KAFL bears no medical, malpractice, or regulatory liability.

b) Counsellors, Coaches, and Non-Clinical Practitioners

Services are supportive or educational only unless legally permitted otherwise. KAFL does not validate quality, accuracy, or outcomes.

c) NGOs and Non-Profit Organizations

KAFL does not verify beneficiaries, impact claims, fund utilization, or regulatory compliance. All fundraising and representations remain the NGO’s responsibility.

d) Employers and Job Providers

KAFL is not an employer, recruiter, or placement agency. Employment decisions and labour compliance rest solely with employers.

e) Care Centres and Institutions

Facilities are solely responsible for safety, supervision, staffing, and care standards. KAFL does not inspect, audit, or certify facilities.

7. Data Use and Confidentiality

Partners shall:

  • use user data only for lawful and authorized purposes;
  • maintain confidentiality and reasonable security safeguards;
  • comply with applicable Indian data protection laws.

Misuse of data may result in immediate suspension or termination.

8. Suspension and Termination

KAFL may suspend or terminate Partner access at its sole discretion, with or without notice, where:

  • legal, regulatory, ethical, or reputational risk arises;
  • this Policy or the Terms are breached;
  • continued association may harm users or KAFL.

9. Limitation of Liability (Aligned with T&Cs)

To the maximum extent permitted by law:

  • KAFL shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages;
  • KAFL shall not be liable for Partner acts, omissions, advice, services, negligence, misconduct, or outcomes;
  • KAFL does not guarantee accuracy, suitability, availability, or results.

To the extent liability cannot be excluded, KAFL’s total aggregate liability shall not exceed the limits stated in the Terms and Conditions.

10. Indemnity

Partners agree to fully indemnify, defend, and hold harmless KAFL, its founders, directors, officers, employees, and affiliates against any claims, losses, damages, penalties, or expenses arising from:

  • Partner services or conduct;
  • breach of this Policy or the Terms;
  • violation of law or third-party rights;
  • claims by users, donors, patients, employees, regulators, or beneficiaries.

11. Waiver of Class and Collective Actions

To the extent permitted by law, Partners agree that any claim shall be brought solely in an individual capacity and not as part of any class, collective, representative, or group action.

12. Governing Law and Jurisdiction

This Policy is governed by the laws of India. Courts in Bengaluru, Karnataka shall have exclusive jurisdiction.

13. Severability and Survival

If any provision is held unenforceable, the remainder shall remain in full force. Limitation of liability, indemnity, and governing law clauses survive termination.
